DSA Notice & Action Policy

This notice and action policy explains how NudeLive (“we,” “us,” or “our”) complies with the requirements of the EU Digital Services Act (Regulation (EU) 2022/2065) (“DSA”) regarding the reporting, assessment, and removal of illegal content on our platforms. It applies to all websites and services operated by us that are accessible within the European Union.

1. Purpose and Scope

This policy applies to all users, authorities, and other parties who wish to report potentially illegal content appearing or transmitted through our services.

For the purposes of this policy:

• “Illegal content” means any information or material that violates EU or Member State law—for example, material relating to child sexual abuse, hate speech, terrorist content, fraud, defamation, or intellectual property infringement.

• Reports concerning violations of our Community Guidelines that do not involve illegality should be made through the standard in-app Report tool or via abuse@nudelive.com.

2. Submitting a Notice of Illegal Content

Notices of potentially illegal content may be submitted to us by:

• Using the online Notice Form (available at https://nudelive.com/contact/#report); or

• Emailing abuse@nudelive.com with the information listed below.

Required Information

To be considered valid under the DSA, a notice must include:

1. A clear description of the content alleged to be illegal and an explanation of why it may violate EU or Member State law;

2. The exact location of the content (for example, date, time, and description of the live session or link to stored material, if applicable);

3. Your name and contact information (for follow-up or clarification); and

4. A good-faith statement confirming that the information provided is accurate and complete.

Incomplete notices may be rejected if we cannot reasonably act on them.

If the notice concerns an immediate threat to life, safety, or the sexual exploitation of a minor, it should be marked URGENT in the subject line to ensure priority handling.

3. How We Assess and Act on Notices

All valid notices are reviewed promptly by trained moderation and legal staff.

Upon receipt, we will:

1. Acknowledge the notice (if contact details are provided);

2. Evaluate whether the material is illegal under applicable law; and

3. Determine whether to remove, restrict, or maintain access to the content.

If we remove or disable access to content, we will provide a statement of reasons to the user (if identifiable) describing what action was taken and why.

In cases involving child sexual abuse material (CSAM), human trafficking, or credible threats to life or safety, we may refer the matter immediately to law enforcement or the National Center for Missing and Exploited Children (NCMEC), consistent with our Safety and Reporting Policy.

4. Appeals and Redress

If you believe content was removed or restricted in error, you may appeal the decision by contacting abuse@nudelive.com within 14 days of notice.

Appeals are reviewed independently to ensure fairness. Where applicable, users may also seek judicial redress under article 20 of the DSA or applicable national law.

5. Point of Contact for EU Authorities and Users

Under article 11 of the DSA, we maintain a designated Single Point of Contact for Member State authorities, the European Commission, and the European Board for Digital Services, as well as for users within the EU.

We respond to verified requests from authorities and users in a timely manner, consistent with applicable law and this Policy.

6. Recordkeeping and Transparency

We maintain an internal log of all DSA-related notices, actions, and appeals. Each record includes the date received, type of notice, action taken (if any), and rationale.

Aggregated statistics regarding notices and actions may be published in our periodic transparency report. We do not disclose personal data of reporters or users in those reports.

7. Abuse of the Notice System

Knowingly submitting false or misleading notices is prohibited and may result in legal consequences. We reserve the right to disregard notices submitted in bad faith, spam, or without sufficient information to verify the claim.

8. Policy Updates

We may revise this policy from time to time to reflect changes in law, procedure, or moderation practices. Updates will be published on our website and, where required by law, communicated through appropriate channels. Continued use of our services after those updates constitutes acceptance of the revised policy.
